Mediation is something which is relatively well known in some legal areas such as family law but not so well known in other areas. However, it is becoming increasingly important in the workplace where difficult situations seem to be on the rise in many countries.
A different approach is taken to mediation depending on national laws and understanding of the rights and responsiblities of employers and employees. In some countries, in certain cases, judges insist on parties to a dispute agreeing to mediation before arrival in their courts; in other countries, the use of mediation is non-obligatory, not a legal requirement.
In Switzerland, the idea of mediation in the workplace is a relatively new concept and a 2012 Court decision advised that companies introduce a « person of trust » to help in work related conflict. To our knowledge, this is not yet a well-used practice to date.
Besides, mediation is a tool that can also be useful in our daily life in the relationships with our family, friends, the administration and so on.
Mary Mayenfisch-Tobin is an Irish lawyer, an accredited mediator and an educator who has lived in Switzerland since 1987. She will talk about conflict, mediation, law and the concept of a safer, healthier workplace for everyone.
Isabelle May Laugier is a certified coach and workplace mediator accredited by the Swiss FSM. Based in Lausanne, she is a « person of trust » working with Swiss companies.
